L1 B to H1B
Hi,
currently i am working on L1B for company A, through a consultant I applied H1b and got approved as of OCT/NOV 1st. All my friends are saying that I am on H1B and illegal to continue working for company a on L1B.
Right now i dont want to switch my current comapany and go to work with that consultant.How long I can continue on L1B , as my L1B visa expires on jan 2010.
I didnt get stamped for H1B.

Thank you for your question.
Unfortunately, your friends are probably correct. Assuming the consultant applied for your H-1B using change of status, your status changed automatically on the date of the approval or October 1 (if it was approved before October 1). This means that as of such date, you are no longer authorized to work for Company A.
If you do not want to switch companies, you have two options. You can have Company A file L-1 change of status on your behalf to put you back into L-1 status or you can leave the U.S. and travel back to the U.S. using your L-1 visa stamp.

How to know If My h1 is applied with COS or not?
my status in the site is approval sent(its not written anywhere that the status is change) |

The best way to know for sure is to ask the consultant company or its attorney to provide you with a copy of the approval notice. However, in cases such as yours where you are already in the U.S., change of status is almost always used. |
