Q.

illegal stay

my girlfriend went to USA with H-1B visa, many problems because certificate was not good. She could stay with visa till end of july but she stayed longer and a lawyer told her now when she will leave USA now she never can travel anymore anywhere because she has a recordas illegal person.Can she go back to the Phiippines without problems?What will happen if she stays longer?What are the possibilities

A. Exact dates would be helpful here. As far as I can tell, if she left there would be no 3 year bar upon re-entry. There might be problems at the foreign consulate obtaining a visa however. This might be more appropriate for a phone consultation. That way we can talk more specifics. If not, please indiciate more detail about the "certificate not being good" and the date the H-1b was valid until. If she stays longer than 6 months past her I-94 validity, a 3 year bar to re-entry will attach if she leaves the country.
