can i apply for a green card after i granted a 3 mths visitor visa extension?

An application for U.S. lawful permanent residence (green card status) is based upon an approval of an immigrant petition and an available immigrant visa number. An immigrant petition is submitted by a qualifying family member or employer (based upon a labor certification from the U.S. Department of Labor). Depending upon how you apply for the green card, in what category, and who applies for you (who is your sponsor/petitioner), this process can take anywhere from six months (marriage to a U.S. citizen) to four years, or even longer for some of the other immigrant categories.
If you only have three months left to remain in a period of authorized stay in the United States, it is unlikely that a green card application can be completed for you before you are required to leave the U.S.
It may be possible to apply for a change of nonimmigrant status, in order to allow you to stay and possibly work or study in the U.S. longer, but that will depend upon your indivicual situation. You should consult with an experienced immigration attorney before making any decisions. |
