L1B & i-94 Extension with H1B Approved
I am currently in US in L1B Status. My L1B Visa & Petition are valid until Dec 2008. I have an approved H1B Petition from Oct 2008, but without change of Status. Now my L1B Company is applying for L1B Extension.
If the L1B Extension gets approved, will it affect my approved H1 B Petition ? or is the H1B petition still valid even after L1b Extension gets approved ?
My plan is, if the L1b extension gets approved, I wish to work for L1b company for another 1 year and then switch over to H1B. can u please confirm whether this is legal ?

Approved H-1B petition [with no change of status] is independent of the L-1B status and extension.
You can switch over to the H-1B at any time during the validity period of the approved petition.
Best of luck! Jim |
