H4 expire date
Hi,I came to us with H4 visa on 12feb2008 after 2 month when I applied for a school I saw my visa didn't have petition expire date, it only had 3 month date for enterance to us that was expired on 26feb2008 jut 12 days after my enterance,then I applied for extention on 29may2008 and my case is still depending in vermont center,Ican't do any thing even I can't apply for driver's licence while I have twin boys who are going to school here please let me know what can I do about this situation (my husband's H1 visa is valid until 30oct2009). thanks

Thanks for your question. I will need a number of clarifications a
s I cannot understand very well your current visa circumstances from your question.
I think a useful distinction between duration of your visa stamp and the duration of your status, once you are in the U.S., is helpful. The expiration on your visa stamp in your passport indicates the last date on which you can enter the U.S. with your visa stamp. However, once you are in the U.S., the expiration of your status is almost always different than your visa stamp expiration. In H-4 category, once you enter the U.S., your status is generally as long as the underlying H-1B visa status expiration.
When you say that you applied for H-4 extension, I assume that you applied for extension of your H-4 status based on extension of the status of the underlying H-1B - is this correct?
I am not very familiar with the Maryland DMV rules, but you should be able to apply for a driver's license based on your pending extension of status request and your husband's H-1B approval document which is valid until October 2009. Is your main concern that the Maryland DMV does not allow you to apply for a driver's license with your current documents?
