Q.

H1b approved, got laid off during opt cap gap extension

I was working under OPT since May08. Recently I got approval for H1b status starting Oct09 and worked under the opt cap gap extension rule before I got laid off 8/31/09. If I go back to school and obtained new F1 status, and get a job offer shortly after that, can I work immediately and process a new H1b petition? (without waiting until Apr'10)
