Situation:
5 and half years done on H-1B Visa. Labor, I-140 approved. Facing a layoff.
1. Is my employer obliged to give me I-140 if they lay me off.
2. Can the new employer get a 3 year H1-B extension based on the approved I-140?
3. Do I need a copy of I-140 for the new employer or could the new employer extend H1-B for three years without the I-140 copy?
4. If the current employer doesn't provide the approved I-140 details, is it still possible to get a H-1B extension through another employer?
