Q.

I-797B without I-94 Extension, my wife got H4 w/ I-94 extension

I transfered my H1B visa from Company A to B last Feb 2009. The USCIS people sent me the H1B approval notice without I-94 (I-797 B). But my wife got the H4 with I-94 extension. So my attorney told me that USCIS people made some mistakes, so we'll apply for the Duplicate Approval Notice with added instructions and with my wife's H4 (with I-94) approval copy. But again I got the duplicate approval notice (I-797B) without I-94.

I have my previous employer's I-94 upto Sep-30-2009.

Questions:
1. Can I apply for I-129 again to extend the status with this approved notice? If I'll apply, can i get the I-797A with I-94 with out any problem?

2. Once i applied I-129 can I stay after my I-94 expiration period untill i get this approval notice?

3. Can I go to Canada for stamping?
