My wife H1 is valid upto Sept 2009 with company A and she applied for H1 transfer to Company B and it got denied and on the basis of that my kids I539 application denied. USCIS mentioned that the decision resulting in the denial of I-539 leaves my kids without lawful immigration status. they left US within 30 days as per letter. Now My family wants to apply H4 on my H1 visa. In this case what answers to be given in DS 156 for below questions?
Q31. Have you Ever Been Refused a U.S. Visa? if yes, When? Where? What type of Visa?
Q38(4). Have you ever violated the terms of a U.S. visa, or been unlawfully present in, or deported from, the United States?
Also would like to know where we can provide the H1 transfer denial and I539 denial details in DS 156.
