Q.

L1 to H1 change of visa status

Hi, I am currently holding L1 from my present company A. My H1 got approved through another company B this year under FY2008 cap. My current L1 assignment got over in July,2008 (although my L1 is valid till may2010), I am back home in India for now.
My "to be" new company B claims to have got my H1 done under some "change of status thing" & is asking me to travel to US within last week of Nov,08 or else there would be some legal issue from USCIS.
Is there be any legal obligation from USCIS which says that I have to travel to US by Nov,08 (in my case specifically) in order to keep my H1 alive.. I mean do I have to really travel to US by Nov,08 in order to keep away from any legal issue?
