H1B EXTENSION DENIED AND PRESENT I94 EXPIRED
My Employer applied my H1B extension on Feb’2009. My employer received Query by INS on March requesting for evidence letter from end client, which was responded in April 2009.
Finally My H1B extension got denied on 23rd July 2009. My old H1B visa already expired on 29th Feb 2009.
1.Can I apply H1B transfer with another company?
2. If my employer applies MTR(Motion To Reopen) on denial case, what are the chances and possibility of time INS take to respond?
3. If we applied for MTR, Can I still try H1B transfer with another employer? If so, am I eligible to work once I get receipt/LIN on H1b transfer? or do I need to wait for my H1B transfer to get approved?
4.If MTR is applied, am I eligible to work?
5.Does INS check on previous denial to approve or deny my H1Btransfer?
