Q.

H1 Extension denied, I140 approved

Here is the case:

1. Came to US in April 07. Valid H1 and I94 till Oct 01, 2009
2. Filed extension in PP 2nd week of April 2009. Got RFE. Responded and the visa extension got denied..because of missing contract and invalid LCA.
3. On June 23, 2009, I140 got approved

What are the options available to me now-
1. Can i refile my extension based on approved I140
2. If i go back to India on Oct 01, 2009, do i need to file a fresh H1 or can i still transfer / extend based on approved I140
3. If i file a new H1 through a new employer, will i be counted against cap? Can my new empployer do this filing at point of time or only on April 01
4. How is the approved I140 useful for me
