H1B to F1 but with a permanent residency application
Hi,
Previously I applied for a green card with my first company, then before passing the 1st phase (Labor) I left for another company.
In this second company I also filed for a green card with them and JUST recently passed the Labor phase but didn't file for the second phase I-140. I am now dropping the green card process with the company's lawyer and will be dropping the H1B since I got accepted at Columbia for a 1 year Full Time Masters. I just received the I-20 from them and will proceed with the change of status from H1 to F1.
My question is: am I eligible for an F1 visa, knowing that I applied previously for a Green card and knowing that the farthest point I reached in the process was the Labor phase? (Note: I still have 3 years out of 6 years for the H1B)
