Q.

Travel during H4- H1 Processing.

Hi,

My Wife is in US on H4 Visa.Her H4 visa is valid till Aug 2010. She filed her H1 application in April 2009 through a consultant and currently under process (A RFE has been raised and we have submitted the dcouments too)

She need to travel to India immediately for personal reasons.

1) Is she is ok to travel to India on H4 and return back on H4? If she returns back by Sep 1st Week, then can she work from Oct 2009 once H1 is approved?

2) What will happen, if her H1 Petition gots approved and she still want to return on H4? Can she later go back and get H1 Stamped from India and then can start work?

3) What do you suggest the best option in this? I am ok to get her H1 Stamped at later part of time.
