Q.

Gap period

My H1-b expires on 06/30/09 and application for another H1B is filed which will start on 10/01/09(cap H1B).

Will I be considered out of status during this period. If yes What can I do to fill this gap.

I have a son too who is 18yo and is on H4. My future plan is to file Greencard based on employment and include him too on the petition.
