Q.

Layoff while on STEM OPT - H1B approved

Hello,

I am currently on STEM OPT(Expiring March,2010) and have got my H1B approved(COS) starting Oct.1,2009.
I am getting laid off from my current employer on July 10,2009.

1. My employer lawyer said that they do NOT have to revoke my H1B until it starts, that is Oct 1,2009. I can stay in the US on OPT until Oct 1. Can I use my current H1B slot to transfer to another employer before Oct 1st?? Is there any possibility of complications in such a transfer??

2. What options do I have as far as going back to School?? I have an admit in a university starting August 2009. Is there any way that I can pursue this option? How do I ensure continuing on F1 Visa or COS to F1?? Please suggest me some options and risk level associated with each.
