Q.

J2 to H1B

I am on j2 visa and got my H1B that will in effect from Oct-01-2009. My wife is on j1 and her visa is going to expire on Aug-26-2009 eventually my j2 status will expire on same day.If i count grace period of 30 days, we can legaly stay till Sep-26-2009.Still ther will some days left between Sep-26-2009(j2 Expire) and Oct-01-2009(H1B effective) to make me "Out-Of-Status". What i should do ,so that i will not face any legal problem(if any) ?
Should I go back to India(home country) to save my 5 days "Out-Of-Status"? Or I should file H4 along with my wife's H1B that she is going to apply for and exptected go get by Aug-31-2009(non-cap) ? If i will be changed to H4 at this stage then how can i come back on H1B and start working ? Please advise me considering all in detail.
