Q.

Letter to USCIS - Cause of H1B denial - Effect on H4 stamping

Hi,

My wife's H1B stamping is almost denied beacuse the university which hired her did not send "Letter to USCIS" as a part of the petition.

Visa officer said that - we have recieved you TAL clearence and everything else seems to be in place but 'if you do not provide the Letter to USCIS we wil deny your H1B'. University says that they dont provide such document so they can't do anything.

Is this Letter to USCIS so critical that VOs can ruin someones career? Is there any alternative at all? They sent the job requirement, her resume and they are hiring her because she is qualified. Is that not enough?

Lets assume that her H1 gets denied will that have an effect on my wifes H4 stamping if all my documents are in place.

Please respond this is very critical.
