Q.

H1 to F1

I am on H1B visa laid off in 01/2009.
Employer is asking to come on F1 or H4 visa as my spouse is still working.Can I work on F1 visa? If I got a project can I again come back on H1 visa? My I-797 for 3 years is expiring in 11/2009.
If I will change my status to F1 can I claim my wages from my employer as he did not paid me since 01/2009 and what is the best option F1 or H4?
