Q.

F1 to H1 and back to F1

My situation: Entered US in Aug 2005 with F1 (valid thr Aug 2010). OPT: Jan 07-Sep 07. Got H1B approval under Masters quota and valid since Oct 07. However I haven't left the country since then and my H1 B has not been stamped yet

I would like to get married now and go to my home country. What are my options now?

a. Under current economic conditions, is it safe to leave the country on H1 and risk stamping?

b. Can I file for COS to F1. I heard that USCIS is scrutinizing this process.I have my pay stubs up to date and can provide the necessary documents. What is the risk involved in this process? Do I have to get my F1 stamped again if I have to reenter?

c. How do I go back to H1 again? Do I have to file for new H1 or can I use the existing one if its not revoked by my employer?
