Entered US on H4 in March 08 on H4(valid till Sep09). got H1 in Oct 08, its not stamped yet. am on bench till date. my I797 and new I-94 with me.
1)Can I go to India for a week & come back to US on old H4 visa? Should it be done BEFORE 180 DAYS from Oct 01 08? what happens if I go now & come back in week?
2)Does US consulate ask for payslips etc if I go for H4 stamp in india now?
3)What would be best to fill in the immig form at POE for Q) - Have you ever violated the terms of a U.S. visa, or been unlawfully present in the US? What should I answer as am out of status for 7 months?
4)Crossing border (Mexico/Canada)with the H4 solve the problem? will it supersede H1B? Or Is it better for applying COS? how many paystubs are required for COS? Is 1 and 1/2 month ok or we need 2 months min?
