Q.

Returning on 180th day after going out of country

I am working for company A on L1 visa from Oct-1-07 to till date (Mar-23-09). My L1 visa is valid till Dec-15-09. Company B applied L1-H1 COS on Apr-1-08. My COS got approved with effective date Oct-1-08. But I didn't join company B till now, because no projects in company B.

Recently I came to know that I have been out of status from Oct-1-08,and being out of status for more than 180 days, will create problems.

1) I am planning to go to india on Mar-27-09 and re-enter US on Mar-29-09. When I counted the number of days I am out of status since oct-1-08, it is becoming 180 days on Mar-29-09. So will it create a problem if I re-enter US on 180th day (Mar-29-09)? Should I return before 180th day.

2) If company B cancels My H1 now, will that affect my future H1/GC processing?
