I am on H1B my Visa and I-94 will be expire in March 2013, my comp has applied for an exten of visa in nov 2012 in normal processing, I have my parents hr, my father is sick n have to go back to India, I have 2 options to get them back: option 1. My brother who is in India he come here to Illinois and take them and I send him a letter and doctor certificate? 2. I take my parents in first week of feb 2013 and come back in 5 days before visa expires, my qstn in opt 2 is, if my I-797 extn gets approved while I am in India or on my way back, will I be given new I-94 date based on new I-797, will the Immigration officer know that I have an approved I-797 or will he still give me I-94 till march 2013, this might override the approved I-94 on approved I-797. have to return asap my wife 2 babies.
