Q.

L/H Visa clock reset

I am completing 5 years in L1 Visa status on 7-Apr-2012 and Planning to return to India on 30-Mar-2012. I am looking for options to work in USA:

1. My company interested to apply for H1B in FY13 cap so that if approved, i can start work from Oct-2012. In this case my understading is I can work only another
year ie. if I start in Oct-2012, I can only work till Oct-2013 as I will be completing totally 6 years. Is my understanding correct?


2. I understand if I am out of USA for one year continuously, then I will again eligible to work for another 6 years in H1B or 5 years in L1.
In my case, If i apply for fresh H1B in FY13 cap (Apply in May2012), But start working only from Apr-2013, will my VISA clock reset?
