My wife received green 221g in New delhi. She works in EVC model. The vendor has expressed interest to hire her & offer h1b. Since response to 221g is taking time we are looking for alternate options. After researching, we can see 2 options (both requires withdrawing of petition application). After any option she will work on EC model:
- She returns to US on H4 (she has valid H4) & the vendor files for new petition.
- The vendor files for new petition while she is in India & she appears for stamping again.
Question:
- Are both options available?
- Which option is safest? I read some people have received second 221g in case of 2nd option.
- Having 221g adversely affects new petition with USCIS?
- Can old employer affect filing of new petition? we don't plan to inform them.
