Q.

H4 - H1B - back to H4

Good evening,

I was on H4 Visa for last 1 year. Recently i applied for new H1 and COS (H4 to H1) with some Consultancy firm. It is approved on 01/10/2012, which means my Status is now H1B.

1. For medical reasons, i don't want to be in H1B and want to change it back to H4. My question is, Can i apply COS back to H1 to H4? I dont have any paystubs or anything since its just 7-8 days before it is approved. Is it the right time to file COS back as i heard there is 60 days rule before you can file COS without paystubs.?

2. IS it advisable to leave US and come back on fresh H4B stamping rather than filling COS (H1 to H4) ?

3. In future if i want to go back on H1B, Will I be exempt from H1B Quota?
