Q.

Filing complaint to DOL against H1 employer

H1 visa ended on Dec 6,2011 and filed H1 to H4 in Nov and got it approved recently.Also I have filed 485(AOS) based on my husband's GC on Dec 2,2011.
Both of our AOS cases are pending.

I worked until my H1 expiry.My H1 employer based in NJ has still not paid my salary for Oct,Nov and first week of Dec-2011.My questions are:-
1.Can I file complaint with DOL about unpaid salary for these months?
2.Should I just fill WH4 form and mail it to NJ hour and wage DOL division?
3.Would it affect my 485 pending application in terms of RFE,rejection etc?
4.What would be your suggestion- should I file complaint with DOL or not?
5.Lastly do you help in filing such complaint if yes I would consult you or please suggest other lawyers who do it?Thanks a lot.
