Q.

H4 to H1

I was on h1 from 2006 to 2009 and my h1 extention got denied in Jan2010 then i left US in June2010, now i am back to US on H4 nov13,11
1)Now i want to transfer to h1,is my case fall in to H1 cap as i was out of US for more than 1 yr ?
2)In case if i nee to wait till april for new cap then if i apply for new H1 do i need to start working from October only ?
In case if i dont fall in cap
3)I applied for h4 exntention with my wifes h1 extention this week, can i still apply for h4 to h1 while i am waiting for my h4 extention ?

4)If i got approved h1 transfer with new I-94 prior to the h4 extension and then if i get new h4 related i-94 in this case what happens?

Do i really need to wait till my h4 extension is over and then proceed for my h4 to h1 change please adivce
