Q.

H1B Extension beyond 7 yrs

Employer A :
EB2 : Labor and I140 approved with Priority Date Aug.2008 (which is current as per latest bulletin)

Employer B : Moved to employer B on Feb. 2011. Employer B is yet to start my GC processing. Current visa expiration with employer B is 12/12/2012 and thats when I will be completing my 6 yrs as well (all vacations inclusive).

I want to know what are my options to continue working after 6 yrs ? As I understand there is AC21 but I think 365 day rule might be an issue with that option since company B has not started the labor as of today.

How about starting my labor asap and if its approved and I140 approved before 12/12/2012 (premium process ?), will I be eligible to get 3 yrs extension ?
There is a role change from A (Technical Lead) to B (Project Manager).
