Q.

Job change in 6th year H1B with PERM approval, I-140 pending

Hello,

Could you please let me know if I can have my H1B transferred to a new employer with following conditions:
1) My H1B (6 years) is expiring in May 2012
2) I have a PERM approval from May 2010, with a priority date of Jan 2010
3) My Original I-140 was rejected (filed in Aug 2010) in Aug 2011 as my attorney messed up skilled vs professional worker check boxes. A new I-140 is filed in Sept 2011 and it's still pending.

Finally, if I can have my H1B transferred to a new employer:
1) can I get the H1B extension for 1 year with my approved PERM from my previous employer?
