Q.

not worked on H1, out of the country for more than one year ;

Hi,
My wife Shwetha got H1 in 2007 she was on H4-dependent but after getting H1 she never worked and her status also not changed.
in 2009 November she went to India and returned back on 2010 November with H4 visa re-stamping.
So can she apply for new H1 or she has to use the old H1 only?
b)If we are going to file for new H1, will there be problem because of of the old H1? as she is out of USA for more then one year.

c)If she has to use the old H1 then to transfer H1 , we do not have the pay stubs. In that case how do we go?
