Q.

H4 to H1B

My wife has completed her MS from University of Georgia on Dec 2010.At present she is in USA on H4.I am on H1B.My company is willing to sponsor her H1B for FY13 H1B.

Ques1: On an average how much time it takes for H1B to get approved?
Ques2: Let’s say her H1B gets approved in a month time. Since she is already in USA, will she be eligible to start working from the day of her H1B approval or she has to wait till Oct 1, 2012 to start working?

There is a possibility that my company can sponsor her H1B at the earliest on Jan 2012, however the H1B quota of 65,000 for FY12 H1B will be filled up by that time hence I am more interested to know about FY13 H1B.

Can suggest any option for her to legally start working here at USA at the earliest, under the given situation.
