I joined company A in Oct 2009. In Aug 2011, Company A got taken over by company B and now I'm working for company B. My petition from 2009 still belongs to company A and is valid until Sept 2012. Company B has applied Prevailing Wage in Sept 2011 and currently waiting for certified wage determination from DoL.
I am currently seeking an employment with company C, who has applied for my H1 transfer under premium processing. On Nov 19th, the case status changed to RFE.
1 - Legally, can I work for Company C while the RFE is in process?
2 - Once I start working for Company C, do I have an option to move back to company B if the RFE gets denied by USCIS. Can company B take me back based on the approved petition previously filed by company A, or do they have to file a fresh petition?
