Q.

cap exempt h1

My wife is on L1 with employer X which was extended this year.She also has H1 frm employer Y filed and approved as CP but never been used or activated. She is travelling next week to India
And will go forL1 stamping. If stamping gets rejected and H1 CAP is over by then, Can Employer X file new H1 based on Cap exempt as she is already counted once on 2009 CAP and has approved petition.
