Q.

Overstay on H4. and restamping

Hi,

I discovered recently that I have overstayed the date on my H4 visa (based on my I-94 and 797). Basically the last time my husband switched jobs, his company got him a new H1 797 extension, but didn't extend my H4 to match his 797.(or file a I-539 or whatever).

I am still in the US but am planning to go back to my home country to get a new H4 stamp. I have overstayed by about 2 months.

Question :
1. Will there be any problem in me getting a new H4 stamp because of the overstay?
2. Should I declare the overstay on the DS160 form and explain that this was just an oversight?
