H4 extension with expired I-94
I am going to file I-539 extension of stay for H4 with an expired I-94. The extension was not filed at the time of H1 extension because of lawyer's ignorance. I-94 and H4 for person holding H4 expired in Aug2011 whereas primary's H1B is going to expire in May2012. 1. Should she leave the country right away or wait for I-539 approval.
2. If she leaves the country, will I-539 application be denied/cancelled automatically. 3. Can she go to US consulate with her I539 pending.
