Q.

Change of Status from L2 to H-1B

Hello There,
- I was working in L-1A between Nov 2007 until March 2011 (I left for India on 6th March)
- Meanwhile, i applied for H-1B privately through a consultancy firm in Nov 2010 and got it approved effective from Apr 2011
- I came back to US in Oct 2011 (few days ago) through an L2 visa as a dependant of my spouse who is working on L-1

Iam getting a job offer from a different consultancy firm asking me to tranfer the H-1B through a Change of Status in Premium and start working soon after getting the approval.

Can i move from L2 to H-1 without exiting USA? Do i not need to get a visa stamp using the new H-1B to re-enter US with a new I-94?

In case if the H-1B transfer is not approved, can i continue to stay in US using my L2 I94?
