Q.

Question about H1-B without recent paystub.

I was fired May 15th from company A. I was on H1-B. Recently, I got a job offer from company B (Sept 1st) and they are helping me to apply for H1-B.

I got a RFE today requesting for paystubs. I do not have any paystub for the last few months and all my paystubs shows wages below the prevailing wages as I put on the H1B application that I submitted. My lawyer who handled the case told me my case is going to be denied if no paystubs are submitted or the wages if not tight with the H1B application. Is this the case?

Can I claim to USCIS that I had a non paid vacation in the last 3 months? Is this going to work?

I heard of consular processing. What does that really mean? Am I applying from the beginning in a US consulate? Do I need to filing other kinds of forms and fees again?
