Q.

7th year H-1b extension options

PERM: March 1st 2011, EB3 cat
6 yrs of H1b expire Jan 28th 2012, includes recapture time
Company is in the process of refiling the I-140 as the previous petition was denied due to ability to pay issues. The lawyer said that the new I-140 cannot be filed in premium. The visa stamp on my passport is currently expired.

What's the best course of action to extend my H-1 by 1 more year
1.Can I get the H-1b extension filed in Nov'11 before traveling outside of US and get approval notice in hand. The intent is to get the visa stamping done for the recapture as well as 1 yr extn
2.If not, do I need to complete the travel for 35+ days to make the PERM 365 days older and then apply for h-1b ext
3.What if the I-140 is denied again, do I lose my H1 ext
4. Please specify the timeline of actions
