My husband's EB1B got NOID and response is due on Sep 24th. His lawyer will withdraw it before that date and reapply Eb1B pp for him. Currently I'm H4 (my husband on H1b). WE both already got EAD based on his Eb1b. I got an offer and plan to start working with EAD on Sep 12th. At the same time, my company will apply H1b transfer for me (I got H1b before). Can I change to H1b after I use EAD? Usually when will USCIS deny my 485 after we withdraw our case? Are there any risks involved? Are there any possibility of me being out of status at any point?
