H1b revoked: questions regarding transfer / status
Hi, I was just informed by my employer that they revoked my H1b starting 9/1. My current H1b is valid until 4/13/2012. Questions:
Can I 'transfer' my H1b to a new employer, or would I have to apply for a fresh H1b now? I was informed that I have 10 business days to transfer. This doesn't make sense, how can I transfer when the H1b is revoked?
If I have to apply for a fresh H1b, how does that work? Is it considered a 'transfer' case or a fresh H1b case?
Also, my AOS for GC (dependent on spouse's GC: he got his GC 2 weeks back) is in process. It might take 3-4 months to get EAD.
If the USCIS takes 2-3 months to actually process the h1b revocation, can I apply for a transfer/fresh h1b in the meantime? Would any of this affect my AOS for GC?
