Q.

H1 approved without I94 card - what are the options

Hello,

My wife came to USA on 27 Feb 2009 on H4B (visa stamped at Hyderabad India). Later in USA, she got job and her employer applied for H1B and got approved. Later my wife's H1B and I-94 expired on 30 Sep 2010. Her employer filed for H1B extension on 25 Sep 2010. H1B approved on 17th August 2011 without I-94 card. During all these times she is in USA, never traveled back to India. My wife is now 26 weeks pregnant, I don't want to send her to India (it is not recommended by doctor to travel such a long distance). So my questions are:

1) Can she go to Canada and apply for H1B Visa?

2) As I see there are lot of delays in H1B visa processing, can she apply for H4B visa in Canada?

3) What are the other options in this special situation where she can't travel to India?
