Q.

H1 Denial + Switching to H4

Hello,

My Wife's H1B expires on 5 Nov 2011. Her employer (a consulting company) is planing to file for H1B extension by mid September. Here are my questions,

1) If my Wife's H1B gets denied in Dec 2011, Is she eligible to apply for Change of Status from H1 to H4 after it gets denied without leaving USA? Her current I-94 with H1 on 5th Nov 2011.

2) How long can she stay in US after the H1B extension gets denied?

Please help me answer the questions.
