Q.

H1 Visa Stamping

Hi, I am in US on H1B and completing 6 years of stay in Jan 2012. My petition (I 797) and I 94 is valid until then. I donot have a valid stamping as it got expired.
Now I need to go to India for few weeks in Oct 2011 and I would require a US visa stamping at the consulate to re-enter into US. Will this be a problem because my H1 is valid only for another 3 months (Jan 2012)? Is there a restriction that the petition should be valid for a minimum X number of months at the time of visa stamping ?

Note : No GC plans and I would return to India after my h1 expiry in Jan 2012.
