Q.

Unpaid wages by previous employer in Wash DC

My previous employer did not pay me the last one and half month wages and also has not revoked my H1-B petition untill now (1.5 yrs). It has been close to one and half year now since I left him and joined another company. He troubled me when I was with him. My question is

Can I file for unpaid wages for the last one and half month I worked with him(FEB-MARCH 2010), If so is filing a case in the small claims court the only recourse as I was told by the DOL DC.

Can I file for unpaid wages for the last one and half year instead of just one and half months since he has not cancelled my H1-B yet. I have been working in another company after I left him in March 2010.I feel like doing this because he troubled me considerably when I was with him.
