H1B Renewal and Transfer Problem

Hi,
My Case details: My H1B got expired on Sept 28 2010 and I have applied for Renewal on Oct 10 2010 even though i have asked for renewal well before..my employer filed for renewal little late. The status from then shows as "Initial Review" in online. My Employer did not communicate anything since then about my status.
He Left to India and not responding anymore. He ran payroll till Jan 2011. Recently on July 1st 2011 i have applied for a transfer in premium with other employer. I got a query asking for last 5 months pay stubs. I do not know if i'm currently in legal status. Can you please help me what needs to be done to maintain a legal status. I have a baby 3yr old born here in US. I have been working with no pay since 5 months just to maintain the status.
