H1B extension, 140 approval and transfer
Hi,
I have my current H1b valid till Sep 29 2011 and my I-140 got approved. I have almost an year to re-capture in my current H1 to complete 6 years.
Do I have to re-capture this 1 year or can directly go for 3 year extension ?
If at all I do a re-capture now and if I find a better employment in that 1 year will I be able to do a 3 year H1B request (based on the approved 140) while doing the transfer ?
Is there any rule like if I transfer to a new employer with a 3 yr extn (based on the current 140) the new employer has to start my labor right away ?
What is the impact of current employer cancelling 140 on situations above ?
