Q.

Change of status from J2 to H1B visa

I'm currently on a J2 visa status and I would like to apply for a H1B visa on April 1, 2009. I know I need the waiver in order to get the new visa. If I would apply now for the waiver, I may not get it till April 1st. My question is if I can apply for H1 on April 1st while my waiver is still in pending and update my file by sending the waiver at a later date?
