My wife’s H4 visa is on hold. Embassy told her that I (H1B) could not travel US with stamp of previous employer. She was given 221 g with adminprocessing reqd. No documents are needed. Embassy retained her passport,documents.I took my passport,I797 from Embassy and return US. We sent a couple of emails that I am in US now with attached copy of I94,I797,entry stamp.We did not get any response of emails. My wife called Embassy and they told they would respond in 1-2 days. Its 7 weeks but no response.

Is Embassy waiting for me to apply H1B? Can they approve H4 without I797? I already sent notarized I797 to my wife but she could not submit I797 unless Embassy asked.Are Embassy intentionally giving us hard time as I did not follow Embassy’s suggestion to get H1 B stamp?
