Employer refuse to give relieving letter
Hi, I am Indian citizen and joined an indian company 'X' in India on Aug 2010. This company filed my H1B and sent me to onsite (New Jersey, USA) to work at client location. Now I got an offer from another company 'B' which filed my H1 transfer. I am still working with company 'A'.
My company 'A' has a policy of delaring anyone who resign at onsite as absconding and don't provide any relieving or experience letter. But I also heard that there are lot of exceptions happened wherein this company had provided relieving letters to the employees resigned onsite.
1)Can a company refuse to provide relieving letter to its employee if (2 weeks) notice period is served.
